Terms of Business (GTB) for Use of the Property Provider's Apartments
§1 Scope
Only these General Terms of Business (Property Provider's GTB) are valid
for the agreement between the guest and the property provider.
§2 Conclusion
of and Withdrawal from the Contract
1. Only the agreed-upon price and period of use apply.
2. Both parties agree that the furnished apartment is not rented for residential
purposes, but as an accommodation for a specified period of time.
3. Withdrawal from the Contract
If the guest decides to withdraw from the contract, s/he is obliged to
compensate the property provider for the losses incurred. Upon declaring
his/her intent to withdraw, the guest shall be obliged to pay the property
provider a lump-sum compensation of:
Up to 21 days
prior to the start of the period of use = 0 % of the fee agreed upon in
the contract
From 20 days = 20 %
From 15 days = 40 %
From 10 days = 60 %
From 5 days = 80 %
From 4 days = 100 %
§3 Use
1. The furnished apartment will be made available as of the time agreed
upon for the hand-over of the keys (as a rule: noon). The apartment must
be left in an orderly condition at the agree-upon time on the last day
of use (as a rule: 10 a.m.).
2. The guest will be provided with a clean and orderly apartment whose
furnishings match those in the inventory list on display in the apartment.
If the guest discovers any damage upon first entering the rooms, s/he
is required to report it immediately to the property provider's service
center.
3. Guests assume full liability for any damage that they or their guests
cause. They are obliged to bear all costs arising from such damage, including
the possible loss of additional occupancy contracts.
4. The guest agrees to observe the rest periods valid in the building
in which the furnished apartment is situated (1 p.m.- 3 p.m. and 8 p.m.-7
a.m.).
§4 Vacating
the Apartment
1. When vacating the furnished apartment, the guest will make sure that
all windows and doors are closed and that all water faucets and electrical
devices/systems are turned off. Additionally, the guest will leave the
apartment in a clean and tidy condition.
2. The guest will make an appointment in advance by telephone for both
the acceptance and the surrender of the apartment keys.
§ 5 Time of Payment, Delayed Payment
1. Diverging from legal regulations, the fee for the entire period of
use is to be paid in cash upon acceptance of the keys. The property provider
shall accept the fee in cash and furnish a receipt for it.
2. If the room is occupied without payment of the fee, the guest is deemed
to be in arrears with payment. S/he shall be obliged to compensate the
property provider for the damage caused by delayed payment.
3. The place of execution for all claims arising from the contractual
relationship is the German federal state of Berlin.
§6 Data
Security
The property provider assures the guest that no information will be disclosed
to third parties on the manner, scope, place or purpose of collecting,
processing and using personal data to make bookings. The guest explicitly
permits the property provider to collect, process and use this personal
data.
§7Travel
Contract Law (Reisevertragsrecht)
The property provider is not a travel business. The rights and liabilities
of travel businesses as specified in the provisions of the German Civil
Code (Bürgerliches Gesetzbuch) do not apply.
§8 Applicable
Law and Jurisdiction
No agreements or subsidiary agreements other than those in the contract
are valid. The place of jurisdiction is Berlin.
§9 Severability
Clause
If any provisions in the German Terms of Business are or become ineffective,
the parties will attempt to find a permissible provision that is commensurate
with the intended provision. This shall not affect the validity of other
provisions.
